The terms that govern working with BayFi Studio, and how we handle your data. Plain language where we can manage it: the important parts are still binding.

These Terms of Service ("Terms") govern your access to and use of the BayFi Studio website, and any design, product, branding, motion, or development services ("Services") provided by BayFi LLC ("BayFi," "we," "us," or "our"), a studio based in Rangpur, Bangladesh, serving clients globally.
By accessing our website, submitting an inquiry, booking a call, or engaging our Services, you agree to be bound by these Terms. If you are entering into this agreement on behalf of a company, you represent that you have the authority to bind that company.
BayFi provides design and development services including Brand Identity, UI/UX Design, Product Design, Motion & Animation, Web Design & Development, and Content Creation. The exact scope of work for any engagement is defined at the time of booking or in a signed proposal, statement of work, or project brief.
We offer three ways to work with us:
Current pricing, inclusions, and turnaround times for each plan are published on our Pricing page and may be updated from time to time. The terms in effect at the time you subscribe or sign a proposal apply to that engagement.
Studio and Studio Pro are billed monthly in advance, in U.S. dollars, starting on the date you subscribe. Custom Projects are billed according to the payment schedule agreed in your proposal (typically a deposit followed by milestone or completion payments).
Subscriptions renew automatically each billing cycle until paused or cancelled. You authorize us to charge your chosen payment method on each renewal date. Late or failed payments may result in work being paused until payment is resolved.
Prices are exclusive of any taxes, duties, or withholding required by your local jurisdiction unless stated otherwise; you're responsible for these unless we're legally required to collect them from you directly.
There are no long-term contracts. You may pause or cancel a Studio or Studio Pro subscription at any time by giving us at least 7 days' written notice (an email to hello@bayfi.studio is sufficient). Your subscription remains active, and billing continues, through the end of the current notice period.
Because our plans are staffed and scheduled in advance, fees already charged for work in progress are non-refundable. If you cancel with time remaining in a paid period, we'll complete any work already started within that period but won't begin new work after your notice takes effect.
Custom Project deposits are non-refundable once work has begun, except where required by applicable law. Any refund not otherwise addressed here is at our discretion.
Studio and Studio Pro plans include unlimited revisions within the scope of the active project brief. "Unlimited" applies to refining and iterating on agreed deliverables: it doesn't cover new deliverables, additional pages/screens, or a change in project direction, which we'll scope and quote separately.
Custom Projects include the revision rounds specified in your proposal. Requests that materially expand the agreed scope will be treated as a change order and quoted before we proceed.
To keep your project on schedule, you agree to:
Delays in feedback or asset delivery on your end may shift project timelines accordingly.
Upon full payment for a given deliverable, ownership of the final, delivered work product (final logos, designs, code, and other agreed deliverables) transfers to you, except for any third-party assets (fonts, stock imagery, libraries, frameworks) which remain subject to their own licenses.
We retain ownership of our proprietary tools, templates, internal processes, and any preliminary concepts or drafts not selected as the final deliverable. Until full payment is received, all work product remains our property.
BayFi retains the right to reuse general skills, know-how, and non-confidential techniques developed during an engagement in future work for other clients.
We treat non-public information you share with us as confidential and will not disclose it to third parties except as needed to deliver the Services (e.g. specialist contractors bound by similar confidentiality obligations), or as required by law.
Unless you request otherwise in writing, we may display completed work in our portfolio, on our website, on social media, and in future marketing materials, and may describe the general nature of the engagement (industry, scope, outcomes). We will not disclose confidential business information, unreleased data, or materials you've asked us to keep private.
Services are provided on an "as is" and "as available" basis. We don't guarantee that any design, product, or marketing outcome will achieve a particular business result (e.g. conversion rates, funding, user growth).
To the maximum extent permitted by law, BayFi's total liability arising from any engagement is limited to the fees you paid us for that engagement in the 3 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data.
In addition to your right to cancel under Section 4, we may pause or terminate an engagement, with notice where practical, if you fail to pay fees due, breach these Terms, or provide unlawful or infringing materials for us to work with.
These Terms are governed by the laws of the People's Republic of Bangladesh, without regard to conflict-of-law principles. Both parties agree to first attempt to resolve any dispute informally by contacting hello@bayfi.studio. If unresolved within 30 days, either party may pursue the dispute in the courts of Rangpur, Bangladesh, except where mandatory local consumer-protection law in your jurisdiction requires otherwise.
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date on this page, and, for active clients, by email. Continued use of our Services after a change takes effect constitutes acceptance of the revised Terms.

This Privacy Policy explains how BayFi LLC ("BayFi," "we," "us") collects, uses, and protects information when you visit bayfi.studio, submit an inquiry, book a call, or engage our Services. It applies wherever you're located, including the EEA/UK (GDPR) and California (CCPA/CPRA).
We collect information in three ways:
We do not collect sensitive personal information (health, biometric, financial account, or government ID data) through our website.

You can control or disable cookies through your browser settings at any time. Blocking cookies may affect some site functionality, such as booking a call directly through the widget.
If you're located in the EEA or UK, we process your information on the following legal bases: your consent (e.g. newsletter sign-up, analytics cookies where required), performance of a contract (e.g. delivering Services you've engaged us for), and our legitimate interests (e.g. responding to inquiries, improving our site), balanced against your rights.
BayFi is based in Bangladesh, and the third-party services we use (Google, Mailchimp, Cal.com) may process data in the United States or other countries. Where we transfer personal data internationally, we rely on the transfer mechanisms and safeguards those providers make available (such as Standard Contractual Clauses), consistent with GDPR requirements for cross-border transfers.
We retain contact and project information for as long as needed to deliver Services, maintain business records, and comply with legal/tax obligations, typically for the duration of our relationship plus up to 7 years afterward for financial recordkeeping. Newsletter data is retained until you unsubscribe. Analytics data is retained per Google Analytics' default retention settings.
We use reasonable administrative and technical safeguards to protect the information we hold, including restricting access to authorized personnel. No method of transmission or storage is 100% secure, and we can't guarantee absolute security.
Depending on where you live, you may have the right to:
California residents have additional rights under the CCPA/CPRA, including the right to know what personal information is collected and to request its deletion. We do not sell personal information.
To exercise any of these rights, email hello@bayfi.studio. We'll respond within the timeframe required by applicable law.
Our website and Services are directed at businesses and professionals, not children. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided us information, contact us and we'll delete it.
Our site may link to third-party sites (social profiles, client work, partner tools). We aren't responsible for the privacy practices of those sites: review their policies independently.
